The regulations in respect of granting admission to higher semester do not permit admission of the petitioner to 5th semester without clearing all subjects of 1st & 2nd semesters. The petitioner has yet not cleared the 1st & 2nd semesters and as such, he is not eligible for admission to 5th semester. The request made by the petitioner in the petition cannot be considered in view of the MSBTE Examination Regulations and according the request could lead to a breach of the said regulations.
