NO.129/2012 WITH CONTEMPT PETITION NO. 276 OF 2013 IN A.O.129/2012 RAJANI DAVID GAIKWAD

VERSUS

ANITA DOMNIC PARERA@ANITA NISAR SHAIKH AND ANR ...

Advocate for the Petitioner : Shri A. P. Bhandari Advocate for Respondent No. 1 : Shri S. K. Chavan Advocate for Respondent No. 2 : Shri A. S. Kale Advocate for Respondent No. 5 : Shri V. R. Dhorde. ...

CORAM : RAVINDRA V. GHUGE, J.

DATED : 23rd AUGUST, 2018.

...

PER COURT :

1.

Heard the learned advocates.

2.

This Appeal From Order was preferred for seeking custody of a male child, by the applicant wife. Since the child has now attained adulthood by reaching the age of 18 years, this Apeal becomes infructuous and, therefore, stands disposed off.

3.

The pending Civil Application does not survive and stand

923-A.O.-129-12 (group).odt disposed off.

4.

I have also considered the submissions in Contempt Petition No. 276/13 and I have perused the report of Shri Subhash V. Bhor, learned Advocate who is also a trained counsellor. The child, at the relevant time, appeared to be reluctant to reside in a Boarding School.

5.

In the backdrop of these factors, I deem it appropriate to dispose off the Contempt Petition and more so in view of the child has now attained adulthood.
