I have heard the learned Advocate for the petitioners, perused the grounds for challenge and the petition paper book. 2.

Considering the fact that RCS No.564 of 1981 is still pending adjudication before the trial Court, I am of the view that this petition can be disposed off by expediting the said suit. Learned counsel for the petitioners submits that she desires to move an application for clubbing RCS No. 564 of 1981 with RCS No.82 of 2018 on the ground that the petitioner is still in possession of the suit property. 3.

Considering the above, this petition is disposed off with a direction to the trial Court that it shall decide RCS No.564 of 1981 on/or before 31.12.2018, in the event of there being no other legal impediment. The said suit can be considered for adjudication on day to akl/d

BENCH AT AURANGABAD 2 - WRIT PETITION NO. 9789 OF 2018 day basis, if required, keeping in view that it is pending adjudication for 37 years. In the event, the petitioners move an application for clubbing the afore stated two suits, the competent authority shall decide the said application expeditiously, keeping in view that the 1981 suit has been expedited.
