1] The learned counsel appearing for the respondent - Shirdi Sansthan states, on instructions, that the Sansthan will appoint a consultant for studying, surveying and preparing tender document and finalization of the bidding process by inviting applications on publication of an advertisement in the newspapers having wide circulation and after observing transparent procedure in respect of appointment of the consultant,

WP 7938/15 - 2 - the further tender process for upgradation of existing integrated security system and new installation of HD IP CCTV Surveillance system would be undertaken. 2] According to us, the petitioner has no legal entitlement to pray and demand finalization of the earlier tender process. It is always open for the employer / the respondent to take a call as to whether to pursue the tender process or not.

3] In the instant matter, for the reasons recorded in the reply, the earlier tender process has been abandoned and as such the challenge raised in that regard doe snot sustain. Apart from this, a statement is made in respect of observance of transparent procedure for appointment of consultant for pursuing the tender process and in view of the statement made, we do not deem it necessary to interfere in the writ petition.
