Heard the learned counsel for the applicant and the learned A.P.P. for the respondent/State.

The applicant seeks bail in C.R.No.206 of 2024 registered with MIDC Waluj Police Station, District Chhatrapati Sambhajinagar (Aurangabad), for the offences punishable under Sections 302, 120B, 201 read with Section 34 of Indian Penal Code, Sections 3/25 of the Arms Act and Section 135 of the Maharashtra Police Act. 3.

The applicant has been arraigned as an accused with allegations that the main accused transferred him money for purchasing a country made pistol and he made it available. He has business with the main accused. Except the evidence of transfer of money in the bank account, there are no incriminating circumstances against him. There were no antecedents to his discredit.

The learned A.P.P. has opposed the applications contending that the offence is serious. The applicant has facilitated the main accused to eliminate the woman.

Considering the role attributed to applicant and no antecedent to his discredit, the Court is of the view that the detention would serve no purpose. Hence, the order :-

ORDER

i) The application is allowed.

ii) Applicant - Subhash Baban Lahire be released on bail, on furnishing PB and SB of Rs.50,000/-, with one solvent surety of the like amount, in the above crime for the aforesaid offences, on the conditions that, (a) He should not tamper with the prosecution case. (b) He should attend the trial on each and every effective date.
