The applicant - Punjab @ Pankaj s/o Ambadas Kale is seeking bail in connection with Crime No.0320/2020, registered with Hatta Police Station, District Hingoli, for the ofences punishable under Sections 353, 332, 504, 506, 143, 149, 188 of the Indian Penal Code and under Section 48(7), 48(8) of the Maharashtra Land Revenue Code, as also under Section 37(1)(3) of the Bombay Police Act. Heard both sides.
The learned Counsel for the applicant submits that the applicant is in jail in connection with present crime since 27th October, 2020. Investigation is over for all practical purposes and formality of filing charge sheet is only remained. He submits that there is no criminal history. Applicant is easily available for trial. He, therefore,
{2} submits that the applicant may be released on bail. The learned A.P.P. has strongly resisted the application and submitted that the application may be rejected. It has been alleged in the complaint that the present applicant has pushed the homeguard on duty and thus alleged to have committed ofence under Section 353 of the Indian Penal Code. There are allegations about excavation of sand from the river bed illegally, however, said quantity of sand along with tractor is also recovered during the course of investigation. There is no criminal history. In view of the same, I am inclined to release the applicant on bail with certain conditions.
Hence, the following order:
(i) The application is hereby allowed.
(ii) The applicant - - Punjab @ Pankaj s/o Ambadas Kale is seeking bail in connection with Crime No.0320/2020, registered with Hatta Police Station, District Hingoli, for the ofences punishable under Sections 353, 332, 504, 506, 143, 149, 188 of the Indian Penal Code and under Section 48(7), 48(8) of the Maharashtra Land Revenue Code, as also under Section 37(1)(3) of the Bombay Police Act, be released on bail on his furnishing Personal Bond of Rs.15,000/- (Rs.
{3} Fifteen thousand) with one surety of the like amount, on the following condition:
(a) The applicant shall not tamper with the prosecution evidence, in any manner.
(b) The applicant shall attend the concerned Police Station once in a week i.e. on every Sunday between 08.00 a.m. to 11.00 a.m. till filing of the charge sheet.
The application is accordingly disposed of.
