DATE : 14/07/2017 PER COURT :- 1] The petitioner's tribe certificate has been forwarded to the second respondent committee on 5/1/2017. On the basis of the tribe certificate dated 14/8/2013, the petitioner was admitted against a reserved seat in the third respondent-college for Electronic and Telecommunication [E & TC] Engineering course. The admission being against a reserved seat, the petitioner is now desirous of prosecuting his studies further. The petitioner states that he has completed his second year and admission process for the next academic year is going on in third respondent-college. The petitioner is facing difficulties because the admission is not finalized as the petitioner is yet to obtain the tribe validity certificate.
wp8971-17 -22] On perusal of the petition and the annexures we are of the opinion that the petitioner is not at fault if the scrutiny committee is yet to pass final order on the proposal forwarded by the third respondent. In these circumstances, the petitioner may be admitted provisionally to the E & TC Engineering Course in the subsequent years. He be allowed to complete his studies for the course, subject to final orders of the scrutiny committee. The petitioner will not claim any equities. This order would enable the petitioner to appear for the examinations and if successful, obtain mark sheet and certificate as well. The Writ Petition is disposed of in these terms. (MANGESH S.
