This is an application for bail under Section 439 of the Code of Criminal Procedure. The applicant is one of the accused arrested in connection with Crime No.100/2019, registered at New Mondha Police Station, Parbhani, District Parbhani, for the offences punishable under Sections 302, 114, 143, 144, 147, 148 and 149 of the Indian Penal Code and under Section 135 of the Bombay Police Act. The applicant hereby seeks temporary bail, so as to enable him to appear for LL.B. examination.

Heard. Perused the First Information Report (FIR) and related papers.

2 ba-1372-2020.doc Last year also, this Court had granted the applicant, temporary bail for appearing first year LL.B. examination. It appears that he had not misused the liberty granted. With a view to facilitate him to appear for LL.B. examination, the applicant is released on temporary bail in terms of the following order:

O R D E R

(i) The application is allowed.

(ii) The applicant be released on temporary bail in connection with Crime No.100/2019, registered at New Mondha Police Station, Parbhani, District Parbhani, for the offences punishable under Sections 302, 114, 143, 144, 147, 148 and 149 of the Indian Penal Code and under Section 135 of the Bombay Police Act, on executing P. R. bond in the sum of Rs.15,000/- (Rupees Fifteen Thousand Only) with surety in the like amount.

(iii) The duration of the temporary bail shall be from 14.11.2020 to 05.12.2020.

(iv) The applicant shall surrender to jail on 06.12.2020, without fail.

3 ba-1372-2020.doc (v) During the period of temporary bail, the applicant shall report concerned police station thrice i.e. on three different dates during the time convenient to him.

(vi) The applicant shall not tamper with the prosecution evidence.
