Mr. Tope, the learned counsel for the petitioner submits that, application has been filed by the petitioner for the renewal of license of orchestra. No orders are passed on the said application.

Mr. Basarkar, the learned Assistant Government Pleader submits that, the crime has been registered against the employee of the petitioner's orchestra for obscene gesture and obscene song and same is committed on the bar stage. The same is registered U/Sec. 294 of Indian Penal Code and Sec. 33(W)(1) of the Maharashtra Police Act and Sect. 7 of the Public Entertainment

2 wp 8120.15 Act. According to the learned A. G. P. adverse report is given by the Tahsildar in that regard.

The Authority shall pass a formal order on the application filed by the petitioner for renewal of the license. It appears that no orders are passed in the application for renewal of license. The same shall be done expeditiously and preferably within a period of three (3) months from today. The petitioner may file fresh application for renewal of license as case may be.
