This Court vide order dated 20th August, 2013 had directed the petitioners to deposit an amount of Rs. 7,00,000/-. The said amount is not deposited by the petitioners.

According to Mr. Bangar, the learned counsel for petitioner, the petitioners had filed an application U/Sec. 107 of the Maharashtra Co-operative Societies Act, 1960 seeking permission to initiate legal proceedings against the respondent/bank, as liquidator is appointed over the said bank. However, no decision has been taken upon same as yet.

In case application filed by petitioners U/Sec. 107 of the Maharashtra Co-operative Societies Act (Exhibit - D page 18) is pending with the respondent No. 2, then the respondent No. 2 shall take decision on the said application expeditiously and preferably within a period of four (4) months from today. The writ petition is disposed of. No costs. All other contentions are kept open.
