Learned counsel Mr. Dahat for the appellant/Insurance Company, learned counsel Mr. Shaikh Majit for the respondent No. 1/original claimant along with original claimant are present today. They tender on record terms of settlement, which is taken on record and marked as 'Exhibit - X' for identification. 3.

With the assistance of learned counsel for the parties, we have ascertained the identification of the original claimant/respondent No. 1. He confirms the terms of settlement and agrees for the final disposal of the first appeal. 4.

The first appeal stands disposed of in terms of settlement

The respondent No. 1/original claimant shall be entitled to receive an amount of Rs. 1,00,00/- (Rs. One Lakh only) along with accrued interest thereon towards full and final settlement. Balance amount along with accrued interest shall be disbursed to the appellant/insurance company.

A request for refund of court fees shall be processed in accordance with law.
