After having argued for substantial period of time and after this Court recorded the submissions made on behalf of the petitioners on 22nd July 2025, while issuing notice for final disposal, returnable on 26th August 2025, today this petition is circulated on behalf of the petitioners seeking permission to withdraw the petition in order to avail of the alternative remedy.

The learned counsel for the petitioners, on instructions, seeks permission to withdraw the petition with liberty to approach respondent No.2 - National Medical Commission by way of appeal Shrikant Malani

904.WP.8830.2025.doc under Section 28(5) of the National Medical Commission Act, 2019. 3.

In view of the above, the petition is disposed of as withdrawn, with liberty as aforesaid.

Pending applications, if any, also stand disposed of. 5.

It is made clear that we have made no observations on the merits of the matter.

It is further made clear that the issue of limitation is kept open.
