The applicant was arrested on 6th April 2015. Perused the charge-sheet.

The Division Bench, while dealing with the habeas corpus petition in relation to the matter in question has noted that Manisha on oath made a statement that she was not detained against her will by Karan Pawar to whom she claims to have been married. 4.

The said girl was found to be about 18 years of age. 5.

The investigation in the present matter is already complete and the charge-sheet is filed. In view thereof, it will be appropriate to release the applicant on regular bail, who is aged about 66 years on following conditions :

(I) The applicant Popat Namdeo Pawar be released on bail in Crime No.I-111/2009 registered at Jamkhed Police Station, Taluka Jamkhed, District Ahmednagar, for the offences punishable under Sections 363, 366, 385 read with Section 34 of the Indian Penal Code, upon furnishing P.R. Bond of Rs.10,000/- (Rs. Ten thousand) with one surety in the like amount.

(II) In view of the grievance made by learned Assistant Public Prosecutor that the applicant has not co-operated the investigation, learned Counsel for the applicant on behalf of applicant undertakes that the applicant shall attend the trial regularly and shall co-operate in expeditious disposal of the trial.

(III) In case of non co-operation on the part of the present applicant shall result into liberty to the prosecution to move for his cancellation of bail.
