Heard Shri Halkude, the learned counsel appearing for the applicant.

The learned counsel pointed out that respondent no.4-D has been duly served and the affidavit of service in that regard has been filed in the Court on 13.12.2017. Summonses were sent to the said respondent by way of R.P.A.D. and the report as regards service of the said notice is also submitted on record. The said respondent is deemed to have been served. No one has caused appearance on his behalf.

In view of the above, the application is allowed. The legal heirs of deceased respondent no.4 as are

Necessary amendment be carried out within two weeks. List the petition on 02.07.2019.
