Heard the learned counsel for the applicant and the learned A.P.P. for the respondent/State.

The applicant is seeking bail in C.R.No.124 of 2023 registered with Shirpur City Police Station for the offences punishable under Sections 307, 143, 144, 147, 148, 149, 504, 506 of the Indian Penal Code.

It has been alleged that the applicant assaulted the injured with knife on his chest. The incident happened in the market at the the time of Roza in the month of Ramjan. The applicant was immediately arrested. The knife used by him, removed from his hand, has also been seized. There are antecedents to his discredit. Those pertain to another offence. It is the contention of
940-BA-1208-23.odt the applicant that the injured also leads one group and he used to keep the people under threats.

Considering the facts and circumstances of the case and period of languishing in jail, it would not be appropriate to keep the applicant behind bars. Hence, the order:- i) Bail application is allowed.
ii) Applicant Adil Alauddin @ Altaf Shaikh be released on bail, on furnishing PB and SB of Rs.50,000/-, with one solvent surety of the like amount, in C.R.No.124 of 2023 registered with Shirpur City Police Station for the offences punishable under Sections 307, 143, 144, 147, 148, 149, 504, 506 of the Indian Penal Code, on the conditions that, (a) He shall not enter the place of his residence where the injured runs his business till conclusion of the trial. (b) He shall not tamper with the prosecution witnesses. (c) He shall attend the trial on every effective date. (d) He shall not involve in the similar crime. ( S. G. MEHARE ) JUDGE rrd
