The applicant / original defendant no.1 had filed CA No.3000/2010 for bringing the LR's of deceased Venishankar Joshi on record. By order dated 30/01/2013, the civil application was allowed. Though the LR's of deceased Venishankar were brought on record, his widow Kantabai is inadvertently left out. As such, a delay of about 600 days is caused.

This civil application is, therefore, allowed by condoning the delay subject to the applicants depositing costs of Rs.1,000/- only with the Advocate Associations' Bar Library, High Court, Aurangabad within 2 weeks from today. After producing the receipt, the applicant shall bring Smt.Kantabai on record in the second appeal within 2 weeks thereafter.

After the above directions are complied with, the order of abatement of second appeal in respect of Smt.Kantabai shall stand recalled.
