2024:BHC-AUG:16024-DB 1 wp 7888.24
IN THE HIGH COURT OF JUDICATURE AT BOMBAY
BENCH AT AURANGABAD WRIT PETITION NO. 7888 OF 2024 Kritika Shankar Bodhanapod u/g of father Shankar Gangaram Bodhanapod .. Petitioner
Versus
The State of Maharashtra and another .. Respondents Shri Pratap V. Jadhavar, Advocate for the Petitioner. Shri S. P. Joshi, A.G.P. for the Respondent Nos. 1 and 2. CORAM : MANGESH S. PATIL AND SHAILESH P. BRAHME, JJ.
DATE : 29 JULY, 2024.
FINAL ORDER :
.
Petitioner's proposal has been pending with the respondent No. 2/Scrutiny Committee for validation of her tribe claim of 'Mannervarlu' (Scheduled Tribe) since last November. 2.
Posing she is in urgent need of decision in as much as she has appeared for NEET-UG-2024, present petition has been filed soliciting direction to the Committee to decide proposal expeditiously.
3.
Though, we have been passing orders on such similar requests so that career of the students shall not get affected, if the proposal like the petitioner's, has been pending with the scrutiny committee for more than six months. The Committees
2 wp 7888.24 are burdened with thousands of proposals. The petitioner could have anticipated the urgency and could have solicited the direction of similar nature so that even this Court could have been able to grant enough time to the Committee to decide the proposal. Now under the guise of urgency emotionally we may be inclined to issue a direction to the Committee and even the Committee may decide the proposal, but without undertaking a threadbare scrutiny of the proposal. We, therefore, deprecate conduct of the petitioner in approaching this Court at the eleventh hour.
4.
We dispose of the petition by requesting the Committee to decide the proposal of the petitioner as expeditiously as possible and bearing in mind the fact that the petitioner's real sister has been granted certificate of validity pursuant to the order of this Court.
5.
The Committee may consider grant of validity certificate even conditionally as we have done in the matter of petitioner's sister namely Ishika.
