Heard. This is an application for bail under Section 439 of the Code of Criminal Procedure. The applicant has been arrested in connection with Crime No.129/2021, registered at Nilanga Police Station, District Latur for the offences punishable under Sections 302, 307, 324, 323, 143, 147, 148, 149, 504, 506 of the Indian Penal Code and Section 135 of the Maharashtra Police Act.

The bail is mainly asked on the ground of party. The learned A.P.P. has objected to grant the applicant bail in view of seriousness of the offence.

On investigation, the charge sheet has been filed. The trial has not yet commenced. Similarly placed co-accused have been granted bail by this Court. The present applicant, therefore, deserves to be released of bail. Hence the order :-

O R D E R

(i) The Bail Application is allowed.

(ii) The applicant be released on bail in connection with Crime No.129/2021, registered at Nilanga Police Station, District Latur for the offences punishable under Sections 302, 307, 324, 323, 143, 147, 148, 149, 504, 506 of the Indian Penal Code and Section 135 of the Maharashtra Police Act on his executing P.R. bond in the sum of Rs.15,000/- (Rupees fifteen thousand) with one surety in the like amount. (iii) The applicant shall not tamper with the prosecution evidence.
