Heard the learned Advocate for the Applicant and the learned APP for the State. Perused the papers. 2.

This Application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed for Anticipatory Bail apprehending arrest in Crime No. 0424 of 2025 registered with Parner Police Station, for the offences punishable under Sections 118(1), 119(1), 126(2) and 3(5) of the Bharatiya Nyaya Sanhita, 2023. 3.

The case of the Prosecution is that, there was a dispute between the FIR-named accused and the Informant in respect of a way from the Applicant's land. The FIR-named accused including the Applicant assaulted the Informant on 26.05.2025 in the morning around 08:45 am. The Applicant assaulted by an axe on the ear and head of the

2 51aba1220.2025.odt Informant. The Informant suffered injuries for which he had to take treatment.

There is no dispute that the Applicant is named in the FIR and the role of assault by an axe is attributed to the Applicant. The Medical Certificate of the Informant shows the injuries in the nature of CLW over left ear pinna, size 6x1x0.5 cm, blunt trauma over left side chest, mild defused cerebral edema, and all the injuries are shown to be simple to grievous. The other co-accused, who assaulted the Informant, have been protected by the learned Sessions Court. The Applicant is protected by an interim order dated 18.07.2025, on certain conditions. It is nobody's case that the Applicant has misused the interim protection. He has joined the investigation pursuant to the interim protection. The Police Report shows that the axe used in the Crime has been seized. The investigation is almost complete. In this view of the matter, I am inclined to confirm the interim protection dated 18.07.2025. Hence, the following order : -

ORDER

[i] The interim protection granted by this Court to the Applicant vide order dated 18.07.2025, is confirmed. [ii] The Application stands disposed off.
