We have heard Mr. Pagare, learned counsel for applicant, Mr. Palodkar, learned counsel for petitioner in the writ petition and the learned AGP.

The learned counsel for applicant submits that the present applicant had intimated him, but on the relevant date he was hospitalised, and as such, could not appear for the present applicant, though was instructed.

Mr. Palodkar, learned counsel for non-applicant No.1 does not object to the prayer, considering the reason given. 4.

In view of that, the Civil Application is allowed. The order dated 05-08-2021, issuing bailable warrant against the

Mr. Pagare, learned counsel, assures this Court that the affidavit of the present applicant would be filed in the contempt petition within two weeks.

Place the matter on 16th September, 2021.
