Heard the learned counsel for the applicants and the learned A.P.P. for respondent State.

The applicants seeking bail in Crime No. 227/2023 registered with Police Station Pachod, Taluka Paithan, District Aurangabad for the offences punishable under Sections 399, 402 of the Indian Penal Code and Sections 4/25 of the Arms Act.

The police had intercepted two trucks on the secret information that persons therein have prepared for the committing dacoity. Some articles were found in the trucks. Most of the articles recovered from the trucks are general articles normally kept in the truck. Nothing is to be recovered from the applicants. Therefore, their further detention would serve no purpose.

ORDER

(i) The application is allowed.

(ii) Applicant No.1 Ashok Dharmaraj Jadhav, applicant No.2 Ashok Shahaji Shinde, applicant No.3 Ramesh Mahadev Jadhav, applicant No.4 Madhukar Uttamrao Shinde, applicant No.5 Dhanaji Suresh Shinde, applicant No.6 Dashrath Sandipan Shinde and applicant No.7 Vijay Shahaji Shinde be released on bail, on furnishing P.B. and S.B. of Rs. 50,000/- each with one solvent surety of the like amount in C.R. No. 227/2023 registered with Police Station Pachod, Taluka Paithan, District Aurangabad for the offence punishable under Sections 399, 402 of the Indian Penal Code and Sections 4/25 of the Arms Act on the conditions that :- (a) They shall not tamper with the prosecution witnesses. (b) They shall attend the concerned police station as and when called on written notice by the investigating officer, till filing the charge sheet. (c) They shall furnish the proof of their permanent residence and cell numbers with an undertaking that they will not change their cell phone numbers till conclusion of the trial.
