Heard the learned counsel for the applicant and the learned A.P.P. for the respondent/State.

The applicant seeks bail in C.R.No.77 of 2023 registered with MIDC Police Station, Latur, for the offences punishable under Sections 409, 420, 465, 467, 468, 469, 474, 477, 477A read with Section 34 of the Indian Penal Code.

The bare allegation against the applicant is that the coaccused who was his brother had transferred amount of Rs.2 Lakh to his firm. He has case that he has no concern with the business run by the main accused. He did not participate in misappropriating the public funds.

The similarly situated co-accused has been granted bail. Hence, the applicant deserves parity. Hence, the order:-

ORDER

i) The application is allowed.

ii) Applicant - Arun Naghnath Fuleboyane be released on bail, on furnishing PB and SB of Rs.50,000/-, with one solvent surety of the like amount, in the above crime for the aforesaid offences, on the conditions that, (a) He should not tamper with the prosecution witnesses. (b) He should not protract the trial.

(c) He should attend the trial on each and every date. (d) He should submit his residential address proof and mobile phone numbers with the trial Court with an undertaking that he would not change it till the trial is concluded.

(e) He should not involve in the similar crimes.
