Heard the learned counsel for the applicant and the learned A.P.P. for the respondent/State.

The applicant is seeking bail in Crime No. 231/2023 registered with Police Station Osmanabad, District Osmanabad for the offence punishable under Section 306 read with Section 34 of the Indian Penal Code.

It is a case of suicide after love break. It has been alleged against the applicant that he had also love affair with the same girl who was in love affairs with the deceased. However, they were blackmailing him. Applicant made phone calls to the deceased daily. It seems to be intolerable shock to the deceased that same girl was also

942 BA- 1217-2023.odt in love affair with the applicant. The deceased committed suicide at the place of his residence. Nothing is to be recovered from the applicant. Considering the facts of the case the applicant deserves bail. Hence, the following order :-

ORDER

(i) The application is allowed.

(ii) Applicant Yogesh Shivprasad Chagadale be released on bail, on furnishing P.B. and S.B. of Rs. 50,000/- with one solvent surety of the like amount in C.R. No. 231/2023 registered with Police Station Anandnagar, District Osmanabad for the offence punishable under Section 306 read with Section 34 of the Indian Penal Code on the conditions that (a) He shall not tamper with the prosecution witnesses. (b) He shall attend the concerned police station as and when called on written notice by the investigating officer, till filing the charge sheet.
