The learned Advocate representing the respondents, places on record the appointment order issued to the candidate who had scored the highest marks and was at serial No.1 in the merit list, dated 25/05/2022. The same is taken on record and marked as 'X-1' for identification. He also tenders the report of the competent authority dated 07/06/2022, which is tendered to the General Manager Legal at Mumbai, intimating him that the said candidate has joined employment. The said document is marked as 'X-2' for identification. 2.

The learned Advocate for the petitioner submits that in the light

WP 8976-2022 of the above, the petitioner, who was at Serial No.2 in the merit list, cannot be appointed as the selection process was for filling in a solitary post. He, therefore, prays for liberty to withdraw this petition.
