The learned counsel for the appellant/Insurance Company submits that due to passage of time the present matter has become infructuous in view that the final orders are passed and the present order has merged with the final order. In view of the same, the present first appeal is disposed of as infructuous.

In terms of order dated 19.6.2009 in Civil Application No. 4809/2009, the amount deposited in this Court is already transferred to the Motor Accident Claims Tribunal, Ahmednagar and the claimant was permitted to withdraw the same on furnishing security. No further orders are required in this regard.
