Present application has been filed for withdrawal of the amount. Amount of Rs.9,36,121/- has been deposited by respondent No.1.

Learned Advocate for respondent No.1 has strong objection for withdrawal of the amount on the ground of involvement of vehicle. Taking into consideration the fact that a competent Court has come to the conclusion about the involvement of the vehicle, definitely case is made out for partial withdrawal of the amount. Applicant is allowed to withdraw 50% of the amount that has been deposited subject to filing an undertaking within a period of eight weeks that he would make the
