Learned advocate for the applicant submits that two proceedings, earlier in point of time, had been lodged by the present applicant at Dhule, wherein present respondent had put
{2} mca156-16 in his appearance and has been attending to said proceedings at Dhule.

According to learned advocate present proceedings bearing Hindu Marriage Petition No. (A) 257 of 2016 have been lodged by the respondent in Family Court at Aurangabad. Learned advocate refers to various difficulties under which it would be difficult for the applicant to attend to the proceedings at Aurangabad.

Aforesaid submissions go un-controverted and un-rebutted in the absence of the respondent, which may in the present case tantamount to tacit acceptance of the contentions raised in the application. As such, the Miscellaneous Civil Application stands allowed. Rule is made absolute in terms of prayer clause "A". Miscellaneous Civil Application stands disposed of. [SUNIL P.
