Heard the learned counsel for the applicants and the learned A.P.P. for the respondents.

The applicants seek bail in C.R.No.0219 of 2024 registered with Police Station Talwada, District Beed, for the offences punishable under Sections 307, 326, 323, 504 read with Section 34 of the Indian Penal Code.

The learned counsel for the applicants, on instructions, seeks leave to withdraw the application of applicant No.1 - Sugriv. Leave granted.

The allegations against applicant No.2 - Dnayneshwar @ Balu were of abetment. He did not actively participated in the crime. Nothing is to be recovered from him. Therefore, he deserves bail. Hence, the order:-

ORDER

i) The bail application of applicant No.1 - Sugriv Harichandra Talekar stands dismissed as withdrawn.

ii) The bail application of applicant No.2 - is allowed. iii) Applicant No.2 - Dnyaneshwar @ Balu Arun Navle be released on bail, on furnishing PB and SB of Rs.50,000/-, with one solvent surety of the like amount, in the above crime for the aforesaid offences, on the conditions that, (a) He should not tamper with the prosecution witnesses. (b) He should not enter Village Rui,Taluka Georai, District Beed, for two months from the date of his release. (c) He shall attend the Police station as and when called on written notice by the Investigating Officer till filing the chargesheet.
