The prosecution case is that the applicants were arrested in Crime No. I-71 of 2015 registered with Cantonment Police Station, Aurangabad on 09/04/2015 for an offence punishable under Section 399, 402 of the Indian Penal Code and under Section 4, 25 of the Arms Act.

Upon receipt of information, the Investigating Officer noticed that the present applicants were standing near Railway over-bridge and there was recovery of certain articles with chilly powder, as such, were accused of commission of crime under Section 399 and 402 of the Indian Penal Code and in view of recovery of knife under Section 4, 25 of the Arms Act. 4.

The investigation in the matter is complete and charge

The prosecution has reported that there was no criminal antecedents of present applicants.

In view of the nature of accusation and investigation, it will be in the fitness of things, in my opinion, to release the applicants on bail. Hence, I pass the following order.

The applicants be released on bail, upon furnishing their P.R. bond of Rs.10,000/-(Rs. Ten thousand) by each of the applicant, with one local surety in the like amount, in connection with Crime No. I-71 of 2015 registered with Cantonment Police Station, Aurangabad for an offence punishable under Section 399, 402 of the Indian Penal Code and under Section 4, 25 of the Arms Act. Learned Counsel for the applicants conceded that the applicants will provide one local surety in the like amount. 7.

The applications stand disposed of.
