Heard learned counsel for the applicant and learned APP for the State.

The applicant seeks bail in Crime No.88 of 2022 registered with Gategaon Police Station, District Latur for the offence punishable under Sections 302, 201 r/w 34 of the Indian Penal Code. 3.
The applicant is the son of the deceased who has been killed in home. It has been alleged against the applicant that he hired the co-accused to eliminate his father. There is no evidence against the applicant that he actually participated in the crime. 4.
The applicant has a case that the deceased father was consistently harassing his mother and used to be under the influence of liquor. No incriminating evidence is collected against him. The coaccused who has allegedly committed the crime has been granted
958-ba-1330-2024.odt (2) bail. Nothing is to be recovered from him. He is languishing in jail for sufficient time.

The learned APP opposed the application contending that the applicant is an instrumental to eliminate the father. He has provided the weapon and paid the money to the assailant. 6.
Considering the facts of the case and the evidence collected against the applicant, the Court is of the view that the applicant deserves bail. Hence, the following order :
O R D E R
(i) Bail Application is allowed.
(ii) Applicant, Akash Nagnath Kale, be released on bail on furnishing P.B. and S.B. of Rs.50,000/- (Rupees Fifty Thousand only) with one solvent surety of the like amount in the above crime, on the conditions that; (a) The applicant shall not tamper with the prosecution witnesses and shall attend the trial on each and every date.
