By this petition, the petitioner desires that this Court should recover an amount of Rs.34,98,049/-, which is a balance amount payable to him, in the matter of Arbitral Award dated 12.5.2022 and 31.5.2022.

Considering the law laid down by the Hon'ble Supreme Court in the National Highways Authority of India Vs. Sheetal Jaidev Vade and others in Civil Appeal 5256/2022, dated 24.8.2022, more specifically, paragraph Nos. 6.2 and 7, the learned advocate for the petitioner submits that he would avail of the statutory remedy under section 36. He, therefore, prays that this petition may be disposed off.

In view of the above, this petition stands disposed off, with liberty to the petitioner to avail of the remedy, by which the amount can be recovered.
