Heard the learned counsel for the petitioner. 2.

By way of present writ petition, the petitioner challenges the legal heirship certificate issued to all the legal heirs of the deceased including the present petitioner. The learned counsel for the petitioner submits that based on the legal heirship certificate, there is possibility that respondent No. 5 may alienate or create third party right in the suit property. 3.

Legal heirship certificate is merely piece of evidence of heirship and it does not confer any separate right on any individual to create third party right in respect of the property of the deceased and in the event of dispute of legal rights over the property of the deceased the same can be adjudicated in a civil suit.
