This is an Application for condonation of 2541 days delay caused in preferring the First Appeal against the Judgment and Award passed by the learned Reference Court in the Land Acquisition proceedings.

Learned Advocate for the Applicant submits that sufficient reasons are shown in the Application which prevented the Applicant from approaching this Court within the stipulated time. He submits that in the connected matters i.e. Civil Application No. 10466 of 2019 in FAST No. 35265 of 2018 and Civil Application No. 8872 of 2019 in FAST No. 13687 of 2019, this Court has condoned the delay and hence the Application be allowed.

Application is opposed by the learned AGP for Respondent Nos. 1 and 2. None for Respondent No. 3 though served. 4.

Perused the Application. The reasons are mentioned in the paragraph nos. 2, 4 and 5.

For the reasons mentioned in the application, same is allowed in terms of prayer clause 'B', subject to the condition the Applicant shall not be entitled to statutory benefits and the interest for the delayed period.
