Mr S. G. Karlekar, A.G.P. for respondent Nos.1 & 3 Mr S. B. Pulkundwar, Advocate for respondent No.2 CORAM : RAVINDRA V. GHUGE AND SANJAY A. DESHMUKH, JJ.
DATE : 13th December, 2022 PER COURT:
1.
The petitioner desires the following changes to be carried out in his birth record, on the basis of the statutory record indicating the spelling of his name, the date and place of birth and the spelling of his mother's name :- Mistakes as per statutory record Corrections as prayed for Name of the petitioner Jasbirsingh Jasbeersingh Name of the petitioner's Mothers Rajwinder Kour Rajvinder Kour Date of birth of the petitioner 20/04/1996 09/06/1995 Place of birth Amritsir Nanded
(2) 2.
The learned Advocate for the petitioner, therefore, submits that the petitioner desires that the correct date of birth to be recorded, which in fact increases his age by 10 months. He is not praying for reduction of age. The spelling mistake is apparent in his name. The alphabet 'EE' are wrongly replaced with 'I'. Same applies to the name of his mother. The alphabet 'W' is used in place of 'V'. Similarly, the place of birth is recorded as 'Amritsir' in place of 'Nanded'. All these incorrect entries are found in School Leaving Certificate as well as in Secondary School Certificate.
3.
The learned Advocate representing the Zilla Parishad submits that, a proposal will have to be forwarded by the Headmaster of the School to the Education Officer, who in turn would proceed to verify the record and pass appropriate orders. 4.
In view of the above, this petition is disposed off. 5.
We direct respondent Nos.4 and 5 - Headmasters, to forward the proposal of the petitioner to respondent No.3, on or before 21/12/2022. Respondent No.3 would deal with the said proposal for corrections on it's own merits, and after taking into
(3) account the statutory records available. We deem it appropriate to mention, since we have applied our mind, that the corrections in the spelling of the names of the petitioner, as well as his mother and the date of birth, appear to be genuine. Insofar as the place of birth is concerned, the Education Officer is at liberty to verify the records.
