The petitioner is seeking correction of the school record and consequent change in the certificates issued by the respondent No. 2-H.S.C. and S.S.S. Board, pursuant to the decision/order of the Education Officer (Secondary) Zilla Parishad Parbhani purportedly communicated to the respondent No. 2-Board vide communication dated 23.11.2023 (Exhibit ' E'

).

The learned advocate for the respondent No. 2-Board, on instructions, submits that no such communication was ever received by the Board. 4.

Without going into the details, in our considered view, the writ petition can be disposed of by directing the respondent No. 2-Board to take appropriate decision on the proposal (Exhibit 'E' ) in accordance with law and in the light of the order passed in the matter of Janabai d/o Himmatrao Thakur Vs. State of Maharashtra and Ors.; 2019 (6) Mh.J.J. 769. 1/2

The Writ Petition is disposed of. The respondent No. 2 shall take appropriate decision on the application/proposal (Exhibit 'E' ) purportedly issued by the Education Officer (Secondary) Zilla Parishad Parbhani. If the communication is not traceable in the record, Exhibit 'E' shall be treated as that communication and further orders to be passed by the respondent No. 2 as expeditiously as possible and in any case within four weeks.
