The applicant is seeking pre-arrest bail in Crime no.316 of 2016 registered at Mukundwadi Police Station, Dist. Aurangabad for the offences punishable under section 392 r/w. 34 of the Indian Penal Code.

Read the contents of the FIR. There is counter complaint filed, resulting into registration of crime no. 318 of 2016 for the offences punishable under section 392, 143, 147, 148, 149 of the Indian Penal Code. This Court has already granted protection to the applicant - Awadhut S/o Hanumantrao Andhare in Criminal Application No. 2945 of 2016 vide order dated 24th June, 2016.

Prima facie, from the record, it could be inferred that there is hardly any material on record to connect the applicant to the crime in question and false implication of the applicant in the crime cannot be ruled out. Hence, the following order:- 5.
In the event of the arrest of the applicant in Crime no.316 of 2016 registered at Mukundwadi Police Station, Dist. Aurangabad for the offences punishable under section 392 r/w. 34 of the Indian Penal Code, he be released on bail upon his
3 Cri. Appln. 4126-2016 executing P.R. bond in the sum of Rs.15,000/- (Rs. Fifteen Thousand) with one surety in the like amount.

The applicant shall attend the concerned Police Station, initially on 20th and 21st August, 2016 between 10.00 am and 12.00 noon and thereafter as and when called.

The applicant shall not tamper with the prosecution evidence or influence the witnesses in any manner.

Criminal Application stands disposed of accordingly.
