1] The petitioner belongs to Koli Mahadev - scheduled tribe and is in receipt of the tribe certificate issued by the competent authority certifying that he belongs to the aforesaid tribal category. On the strength of the tribe certificate issued to the petitioner, he has been employed as a Technician in the Government Medical College and Hospital, Miraj Dist.Sangli on 27.1.2016. The tribe certificate issued to the petitioner has been referred to the scrutiny committee for verification and the proposal is stated to be pending. The employer has issued a notice to the petitioner calling upon him to
WP 8159/16 - 2 - produce the tribe validation certificate by 12.8.2016 and it is informed that failure thereof would lead to consequence of termination of his services.
2] In the facts of this case, this petition can be disposed of with directions to the respondent no.4 - committee to take decision on the proposal in respect of verification of the tribe certificate issued to the petitioner as expeditiously as possible and preferably within a period of one year from today, and it is accordingly directed. In the meanwhile, the respondent nos.2 & 3 are directed not to take any adverse action against the petitioner on the ground of his failure to submit tribe validation certificate and appropriate action may be taken if deemed necessary, dependent upon outcome of the decision in respect of the verification of the tribe certificate by the respondent no.4 - committee. 3] With the directions as above, writ petition is disposed of.
