PER COURT :- It is informed that, the Insurance Company has deposited an amount of Rs.46,71,930/- in this Court, out of the total amount of compensation Rs.53,05,770/-, together with interest awarded by The Member, Motor Accident Claim Tribunal by order dated 16.5.2015. The applicant No.1 is the father of applicant Nos.2 and 3, who are minor daughter and son respectively. The ends of justice would be met, if the applicant No.1 is allowed to withdraw an amount of Rs.20 lakhs on condition of tendering an undertaking to the Court that, in the event of success of appeal, he would redeposit the amount in this Court within a period of two months from such decision. The balance of amount deposited by the Insurance Company shall be invested in Nationalized bank, in the names of minor applicant Nos.2 and 3, initially for a period of three years and the fixed deposit receipts shall be renewed thereafter for a period until disposal of the appeal.
Civil Application is disposed of.
