Learned Government Pleader appearing for Respondent-State, on instructions, informs that the complaint made by the petitioner on 13.02.2016 would be considered and appropriate decision would be taken on its own merit as expeditiously as possible and preferably within eight weeks from today.

It is expected of the State government to extend opportunity of hearing to all the parties who are likely to be affected by such decision.

Learned Counsel appearing for the intervener informs that the proposal in respect of approval to the appointment is

{3} pending with the State Government.

It would be open for the State Government to consider the proposal together with the complaint tendered by the petitioner on its own merits and in accordance with law. It is clarified that this Court has not expressed any opinion as regards merits of the contentions raised by the petitioner in the instant petition and it would be open for the State Government to take decision on its own merits and in accordance with provisions of law.
