Heard Shri B.R. Sontakke Patil, learned counsel for the petitioner and Shri Deshmukh, learned counsel for both the respondents. Learned counsel Shri Deshmukh has fled caveat. 2.

Learned counsel Shri Patil submitted that the workers were employed in the year 2000 and thereafter, they worked till fling of the complaint. He argued that the learned Member, Industrial Court, Latur, erred in giving the directions as the petitioner had already moved a proposal for making the workers permanent. Therefore, nothing is left to be done by the petitioner from its side.

On going through the order of the learned Member, Industrial Court, Latur, it appears that the learned Member has held that there was no unfair labour practice on the part of the respondents and he has given directions to the respondents No. 1 and 2 to be complied with within a specifed period. Moreover, on the facts of the case, it appears that the work is of perennial nature. Therefore, I do not feel that the learned Member, Industrial Court, Latur committed any error in passing the impugned order. The petition is devoid of any substance hence dismissed. ( M. G.
