At the outset, it is brought to our notice that in the present case the Education Officer (Primary) is the relevant officer and that the Education Officer (Secondary), Zilla Parishad has been inadvertently shown as respondent No. 2. We grant leave to the petitioner to amend the cause title forthwith to show respondent No. 2 as the Education Officer (Primary), Zilla Parishad, Chh. Sambhajinagar. 3.

We have heard learned counsel for the petitioner, learned AGP for respondent No. 1 and Mr. Nangare, learned counsel for respondent Nos. 2 and 3.

The grievance of the petitioner is that his claim for transfer has not been considered by the respondents and that he is eligible to claim transfer as per the policy reflected in the Government Resolution dated 18.06.2024.

With the assistance of the counsels, we find that clause No. 1.10 of the said Government Resolution lays down the criteria for eligibility for transfer. It specifically states that the teacher should have served in a general area or a difficult area continuously for ten years for being considered eligible for transfer. 6.

As per the statement made in the petition itself, the petitioner has continuously served for only about six years in the general area, that is the present posting at a primary school in Taluka Kannad, Dist. Chh. Sambhajinagar. Since the petitioner does not qualify under Clause 1.10 for transfer, there is no substance in the present petition. 7.

Accordingly, the petition is dismissed.
