Heard. This is an application for bail under Section 439 of the Code of Criminal Procedure. The applicant has been arrested in connection with Crime No.0469/2019, registered at Pundlik Nagar Police Station, Aurangabad for the offences punishable under Sections 370(A)(2) of the Indian Penal Code, Sections 3, 4, 5 and 6 of the Immoral Traffic (Prevention) Act, Sections 67 and 67-A of the Information and Technology Act and Section 65-E of the Maharashtra Prohibition Act.

The applicant is in jail since December 2019. The maximum punishment provided for the offence she is charged

with is not more than seven years. The applicant is a woman. Without observing anything on the merits of the matter, this Court is inclined to grant bail to the applicant, in view of the fact that the applicant being a female and having been behind the bars for more than 2 years and 9 months. Hence the order :

O R D E R

(i) The Bail Application is allowed.

(ii) The applicant be released on bail in connection with Crime No.0469/2019, registered at Pundlik Nagar Police Station, Aurangabad for the offences punishable under Sections 370(A)(2) of the Indian Penal Code, Sections 3, 4, 5 and 6 of the Immoral Traffic (Prevention) Act, Sections 65-E, 67 and 67-A of the Information and Technology Act and Section 65-E of the Maharashtra Prohibition Act on her executing P.R. bond in the sum of Rs.15,000/- (Rupees fifteen thousand) with one surety in the like amount. (iii) The applicant shall not tamper with the prosecution evidence.
