This writ petition pertains to the election of the Municipal Corporation, Aurangabad in the year 2006. After declaration of the result of the election, it was noticed that there is a marginal difference of two votes between the petitioner and respondent no.1 who has been declared elected. The petitioner moved an application for recount of votes. Said application came to be rejected by the Returning Offcer. The petitioner, therefore, preferred election petition before the Civil Judge Senior Division, Aurangabad bearing Election Petition No.1 of 2006. However, by order dated 10.11.2006 said Election Petition came to be dismissed. aaa/-

WP 7866.2006.odt Therefore, this writ petition has been preferred. Thus, by effuux of time, this writ petition has become infructuous. Thereafter, twice election has been conducted in respect of the Municipal Corporation, Aurangabad. Writ Petition is accordingly dismissed as infructuous. Rule discharged.
