PER COURT :

Learned Counsels for both sides submit that during Mediation the dispute between the parties is settled and agreement has been entered into. They filed common affidavit requesting this Court for disposal of present Petitions by quashing Summary Case No. 79/2019, 80/2019, 81/2019 and 82/2019 pending before learned CJM and CJSD, Sangamner.

Learned Counsel for the Respondent - Bank submits that it is agreed between the parties that the Respondent - Bank would be permitted to withdraw the some of Rs. 15 lacs deposited by the Petitioners in this Court. On withdrawal of the said amount be allowed to be adjusted towards full and final amount agreed between the parties.

Learned Counsel for the Petitioners, on instructions, gives no objection for withdrawal of the said amount by the Respondent - Bank for further adjustment as agreed.

In view of above, Petitions are allowed.

S.C.C. Nos. 79/2019, 80/2019, 81/2019 and 82/2019 pending before learned CJM and CJSD, Sangamner are hereby quashed. Respondents are permitted to withdaw a sum of Rs. 15 lacs along with accrued interest deposited by Petitioners in this Court. The said amount would be adjusted towards full and final settlement arrived at between the parties. Secretary, High Court Legal Services Sub-Committee, Aurangabad to determine the fees of Mediator.
