The applicant-wife is seeking transfer of proceedings being No. A-930 of 2016 pending on the file of Family Court, Bandra, Mumbai to the Court of Civil Judge, Senior Division, Ahmednagar.

The application is opposed on the ground that there are complaints and counter complaints as
(2) regards criminal act lodged by applicant and respondent against each other. It is then claimed that Pune is the convenient place for parties and the matter be transferred to Pune.

Considering the fact that the applicant has custody of minor daughter, proceedings being No. A-930 of 2016 pending on the file of 6th Family Court, Bandra, Mumbai is directed to be transferred to the file of Family Court at Pune.

At this stage, it is brought to the notice of this Court that the proceedings initiated pursuant to Section 12 of Protection of Women from Domestic Violence Act by the applicant are also pending at Ahmednagar and same be also clubbed with the present proceedings and be heard together. The request appears to be reasonable. The proceedings being Criminal Misc. Application No. 543 of 2016 initiated under the provisions of Protection of Women from Domestic Violence Act by the applicant pending on the file of Chief Judicial Magistrate,
(3) Ahmednagar be also transferred to the Family Court at Pune.

Considering the fact that the applicant before her marriage was serving at Pune, it will be appropriate, in my opinion, to direct the transfer of the proceedings in the Court at Pune.

Misc. Civil Application stands disposed of in above terms.
