We have heard Mr Sagade and learned Advocates for respondents. 2.

It is submitted that the petitioner has already filed proceeding under Section 17 of the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act 2002. As the petitioner has already availed statutory remedy under the Act, Writ Petition cannot be entertained. Writ Petition stands disposed of. No costs.

The petitioner is at liberty to prosecute his application filed under the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act 2002. All contentions of the respective parties are kept open.
