The learned counsel for the petitioner submits that, the present petitioner had filed application for expeditious disposal of the suit. The application is allowed, however the plaintiff is not co-operating in expeditious disposal of the suit. The persons to whom the plots are sold are facing difficulties. 2.

From the record it appears that temporary injunction application filed by the petitioner is rejected. Miscellaneous civil appeal filed by the original plaintiff is also dismissed. There are no prohibitory orders against the petitioner. 3.

It appears that, the Court has already allowed application for expeditious disposal of the suit. If the parties are not co-

2 wp 12453.18 operating in expeditious disposal of the suit, it is for the Court to take further steps. The Court is not powerless to proceed further if a particular party is not cooperating.
