The applicant is seeking bail in Crime No.214 of 2023 registered with Amalner Police Station, District Jalgaon for the offence punishable under Sections 307, 353, 332, 333, 336, 337, 153(A), 143, 147, 148, 149, 323, 504, 506 of the Indian Penal Code, 4/25 of Indian Arms Act, Section 3 to Prevention of Damage to Public Property Act, 1984, Section 7 of Criminal Law (Amendment) Act, 2013 and Section 135 of Maharashtra Police Act. 3.

The papers do not reveal the name of the applicant. There is no substantial evidence against the applicant. It was a riot between two groups. Many persons have been arraigned as an

934-ba-1226-2023.odt (2) accused. Nothing is to be recovered from the applicant. Hence, he deserves bail. Hence, the following order :

ORDER

(i) Bail Application is allowed.

(ii) The applicant, Mohammed Masud Abdul Hamid, be released on bail on executing P.B. and S.B. of Rs.50,000/- (Rupees fifty thousand) with one solvent surety in the like amount in connection with the above crime, on the conditions that he shall not tamper with the prosecution witnesses.

(iii) The applicant shall attend the concerned police station as and when called on written notice by the investigating officer, till filing the charge sheet.
