Heard the learned counsel for the applicant and the learned APP for the respondent-State.

Learned counsel for the applicant would submit that after the bail application was rejected by this Court by order dated 29.11.2021, the applicant approached the learned Sessions Court for bail. The applicant sought the bail, as he was languishing in jail for more than one and half year. He is ready to abide by the conditions including to stay outside the jurisdiction of the place where witnesses reside. He has reiterated the same ground and seeking the bail.

3. Learned APP would submit that after filing a charge sheet, his earlier bail application was decided on merit. This Court

919-BA.1275-22.odt has expressed disinclination to grant the bail. Since then, there are no change-in-circumstances. Hence, the application cannot be considered.

It appears from the order dated 29.11.2021, the Court expressed disinclination to grant the bail. Hence, leave to withdraw the application was granted. Learned counsel for the applicant is unable to point out change-in-circumstances to consider the bail application. Since, there were no change-incircumstances, there is no question to consider the application on the same facts.
