By this Petition, the Petitioner desires to be transferred to the school in which her husband is presently working or any other school in the nearest area. She is working at Loni Khurd, Vaijapur, which is more than 50 kms away from her husband. 2.

Normally, we do not entertain the Writ Petition for seeking choice postings after a candidate has been transferred as per the transfer policies of the Government / Zilla Parishad. However, in this case, the husband of the Petitioner suffered severe Aortic Valve Regurgitation due to Rheumatic heart Disease.

(( 2 )) 42-WP-8451-2024 He underwent an Aortic Valve replacement surgery and is presently using a mechanical valve in his heart.

In the peculiar facts of this case and without laying down any precedent, we call upon the Chief Executive Officer, Zilla Parishad, Chhatrapati Sambhajinagar, Aurangabad, to consider the request of the Petitioner for a transfer nearer to her husband, who is presently working at the Primary School at Asegaon, Taluka Gangapur, District Chhatrapati Sambhajinagar, Aurangabad. 4.

Let such decision be taken on the representation of the Petitioner dated 21.06.2024, within a period of 60 days. Let the Chief Executive Officer consider this case sympathetically. If an option is available that both could be shifted to Aurangabad, only in view of the medical condition of the husband, the Chief Executive Officer is at liberty to take an appropriate decision.

With the above observations, this Writ Petition is disposed off.
